Welcome to Elara. These Terms of Service ("Terms") govern your access to and use of the Elara platform, including our website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. About Elara

Elara is an intelligent health companion that helps you understand your symptoms, find the right type of care, and book appointments with verified healthcare providers in the UAE. Our platform uses conversational technology to guide you through your health concerns and connect you with appropriate medical professionals.

2. Eligibility

To use Elara, you must:

• Be at least 18 years of age
• Be capable of forming a legally binding agreement under UAE law
• Provide accurate and complete registration information
• Not have been previously suspended or removed from the Service

3. Account Registration

When you create an account with Elara, you agree to:

• Provide truthful, accurate, and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account
• Notify us immediately if you suspect unauthorized access to your account

4. Nature of the Service

What Elara Does

• Helps you describe and organize your health concerns through guided conversation
• Suggests the appropriate type of medical specialist based on your symptoms
• Connects you with verified healthcare providers in the UAE
• Facilitates appointment booking and scheduling
• Provides proactive follow-ups and health suggestions to support your ongoing care

What Elara Does Not Do

• Elara does not diagnose medical conditions
• Elara does not prescribe medications or treatments
• Elara does not replace professional medical advice, examination, or consultation
• Elara does not provide emergency medical services

5. Healthcare Providers

Healthcare providers accessible through Elara are independent professionals and entities. Elara does not employ, supervise, or control these providers. By using the Service:

• You acknowledge that healthcare providers are solely responsible for the medical care they provide
• You understand that Elara verifies provider credentials but does not guarantee the outcome of any consultation or treatment
• You agree that any medical relationship is between you and the healthcare provider, not Elara
• You acknowledge that cancellation and rescheduling policies may vary by provider

6. Booking and Payments

• Booking Confirmation: Appointments are confirmed only after you receive a confirmation through the platform. Availability is subject to change.
• Service Fees: Elara may charge a service fee for facilitating bookings. Any applicable fees will be clearly displayed before you confirm a booking.
• Consultation Fees: Fees charged by healthcare providers for their services are separate from Elara's service fees and are determined by the provider.
• Cancellations: Cancellation policies and any associated fees will be communicated at the time of booking. Please review them before confirming your appointment.

7. User Responsibilities

When using Elara, you agree to:

• Provide honest and accurate information about your health concerns
• Use the Service only for its intended purpose of health guidance and appointment booking
• Attend scheduled appointments or cancel within the required timeframe
• Treat healthcare providers and Elara staff with respect
• Not use the Service for any unlawful or prohibited purpose

You agree not to:

• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service
• Impersonate another person or misrepresent your identity
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with others

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, the "Elara" name and brand, software, and design elements, are the exclusive property of Elara and are protected by UAE and international intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Privacy

Your use of Elara is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by UAE law:

• Elara provides the Service on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• Elara is not liable for any medical outcomes, diagnoses, treatments, or advice provided by healthcare providers
• Elara is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Elara's total liability for any claim arising from or related to the Service shall not exceed the total amount you paid to Elara in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Elara, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time by contacting us.

Upon termination:

• Your right to use the Service will immediately cease
• Any pending bookings may be cancelled
• We may retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you via email or prominent notice on the platform

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or relating to these Terms or the Service shall be resolved through the courts of Dubai, UAE.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
